TERMS OF SERVICE FOR IMPACT COACHING

This Terms of Service Agreement ("Agreement") governs your participation in the surf coaching trip ("Trip") provided by Impact Surf Academy ("Company", "We", "Our", or "Us"). By booking and paying for a surf coaching trip, you ("Participant" or "You") agree to be bound by the terms outlined in this Agreement. 


1. General Terms


1.1 Services Provided 

The Company offers surf coaching sessions that include one-on-one or group coaching, video analysis, and personalized guidance. All services will be provided as described on our website or in our communication with you.


1.2 Eligibility 

You must be at least 18 years old to book a coaching session. Participants under the age of 18 must have written consent from a parent or legal guardian which you can find here: Parental Consent.


1.3 Booking and Payment 

Coaching sessions are booked through impactsurfacademy.com or via direct communication (email, phone call, or text with Impact Surf Academy) and must be confirmed with full payment. Payment must be received prior to the session.


1.4 Coaching Session Details 

Session dates, times, locations, and coaching programs are subject to change due to unforeseen circumstances. The Company will notify Participants of any significant changes.


2. Health and Safety


2.1 Physical Fitness and Medical Conditions 

Participants must be in good health and physically able to participate in surfing activities. You must disclose any medical conditions, injuries, or physical limitations to the Company before booking. The Company may request a doctor’s note for any medical conditions that may affect your participation.


2.2 Insurance 

We recommend that all participants obtain personal accident or travel insurance that covers activities like surfing, accidents, cancellations, and emergencies. The Company does not provide personal insurance coverage.


3.Organization and Participant Policies


3.1 For the Organization

Impact Surf Academy is fully dependent on surf conditions and reserves the right to cancel a coaching session based on unsafe conditions, weather, or lack of surf. In the event of cancellation, the Company guarantees the option to reschedule the session.


3.2 For the Participant

A coaching session is confirmed only after payment has been received. Coaching will take place once payment has been processed. In case of cancellation, we kindly ask for at least 24 hours' notice. If canceled within this timeframe, you may reschedule your session. We maintain a non-refundable policy, but we consider each case individually and strive to accommodate as needed.


4. Code of Conduct and Participant Responsibilities


4.1 Behavior  

Participants agree to behave respectfully and in accordance with local laws, regulations, and surf etiquette. Any disruptive behavior that affects the safety, enjoyment, or comfort of others may result in removal from the session without a refund.


4.2 Safety Guidelines  

Participants must follow the safety guidelines provided by the Company and its coaches. Failure to follow safety instructions may result in removal from the session without refund.


5. Limitation of Liability


5.1 Risk Acknowledgement

Surfing and related activities involve inherent risks, including the risk of injury or death. By booking a coaching session, you acknowledge and accept these risks. The Company is not liable for any injuries, losses, or damages that occur during the session.


5.2 Force Majeure 

The Company is not responsible for any failure to perform its obligations due to causes beyond its control, such as natural disasters, strikes, government regulations, or other force majeure events.


6. Privacy Policy


The Company collects and stores personal information for the purpose of providing services related to the coaching sessions. By booking a session, you consent to our Privacy Policy, which outlines how your personal information will be handled.


7. Governing Law and Dispute Resolution


7.1 Governing Law  

This Agreement shall be governed by the laws of Portugal


7.2 Dispute Resolution 

Any disputes arising under this Agreement shall be resolved through mediation or arbitration in Coimbra, Portugal. If you have any concerns or complaints, please contact the Company directly, and we will make reasonable efforts to resolve them.


8. Miscellaneous


8.1 Amendments  

The Company reserves the right to modify or amend this Agreement at any time. Any amendments will be communicated to Participants via email or website updates.


8.2 Entire Agreement  

This Agreement constitutes the entire agreement between the Company and the Participant regarding the Trip and supersedes any prior discussions or understandings.


By booking and paying for a coaching session with Impact Surf Academy, you acknowledge that you have read, understood, and agree to the terms of this Agreement.


TERMS OF SERVICE FOR VIRTUAL COACHING

Welcome to Virtual Coaching with Impact Surf Academy! These Terms of Service ("Terms") govern your access to and use of our online video surf coaching service ("Service"), provided on a single video analysis or subscription basis. By subscribing to our service, you agree to comply with these Terms. Please read them carefully before using the Service.


1. Subscription and Account

1.1 Subscription Plan 

By subscribing to our Service, you agree to pay the monthly subscription fee. Details of the pricing, available plans, and billing cycle can be found on our website at impactsurfacademy.com . Subscription fees are subject to change, and you will be notified of any changes before they take effect.


1.2 Account Creation 

To access the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process, and to update your information as necessary.


1.3 Account Responsibility  

You are responsible for maintaining the confidentiality of your account login credentials. You are also responsible for all activities that occur under your account. If you suspect any unauthorized access to your account, you must notify us immediately.


2. Service Access

2.1 Grant of Access 

Upon successful subscription, you will gain access to CoachNow our video surf coaching content and any associated resources provided via our online platform. Access is granted on a non-exclusive, non-transferable basis for personal, non-commercial use.


2.2 Content Usage  

The video coaching, tutorials, and any other content made available to you are for your personal viewing and learning. You may not download, reproduce, distribute, or use the content for any commercial purposes without prior written consent from Impact Surf Academy.


2.3 Service Availability

While we strive to provide a high-quality, uninterrupted service, we cannot guarantee continuous or error-free access. The Service may be temporarily unavailable for maintenance, updates, or unforeseen issues.


3. Payment and Billing

3.1 Billing Information  

You must provide valid payment information upon subscribing. You authorize us to charge the subscription fee to your chosen payment method at the start of each billing cycle.


3.2 Subscription Renewals and Cancellations

Your subscription will automatically renew on a monthly basis unless you cancel before the next billing cycle. You may cancel your subscription at any time through your account settings or by contacting us at coach@impactsurfacademy.com. Cancellations will take effect at the end of the current billing cycle.


3.3 Refunds

Subscription fees are non-refundable. However, if there is a technical issue preventing access to the Service, we may issue a refund at our discretion.


4. User Conduct

4.1 Prohibited Activities 

You agree not to engage in any of the following activities while using our Service:

- Violating any local, state, or international laws or regulations.

- Distributing harmful, unlawful, or offensive content.

- Attempting to hack, disrupt, or interfere with the Service’s functionality.

- Sharing your account login credentials with unauthorized parties.


4.2 Termination of Access 

We reserve the right to suspend or terminate your access to the Service if we suspect any violation of these Terms, fraudulent activity, or misuse of the Service. In such cases, no refunds will be provided.


5. Intellectual Property

5.1 Ownership of Content 

All content provided through the CoachNow Service or collected by Impact Surf Academy, including but not limited to videos, images, text, and audio, is the intellectual property of Impact Surf Academy or its licensors and is protected by copyright, trademark, and other intellectual property laws.


5.2 License to Use Content  

You are granted a limited, non-exclusive, non-transferable license to access and view the content for your personal use, subject to these Terms.


6. Limitation of Liability

6.1 No Warranty

The Service is provided "as-is" without any warranties of any kind, either express or implied. We do not guarantee that the Service will be error-free, secure, or free of defects.


6.2 Limitation of Liability

To the fullest extent permitted by law, Impact Surf Academy and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.


7. Privacy

Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review our Privacy Policy at impactsurfacademy.com/privacypolicy.


8. Modifications to Terms

We may update these Terms from time to time to reflect changes in our business practices, the law, or the Service. We will notify you of any material changes, and your continued use of the Service after such changes will constitute acceptance of the new Terms.


9. Governing Law and Dispute Resolution

9.1 Governing Law 

These Terms will be governed by and construed in accordance with the laws of Portugal.


9.2 Dispute Resolution  

In the event of a dispute, you agree to attempt to resolve the matter through informal negotiations before seeking legal recourse. If a resolution cannot be reached, the dispute will be subject to binding arbitration in Coimbra, Portugal.

By booking and paying for a surf coaching trip, you ("Participant" or "You") agree to be bound by the terms outlined in this Agreement. 


1. General Terms


1.1 Services Provided 

The Company offers a surf coaching trip that includes services such as guided and coached surf sessions, video analysis and accommodations. Transportation to and from airport is offered with addition fee. Excluded is all airline transportations and flight bookings, which will be responsibility of participant. All services will be provided as described on our website or in our communication with you.


1.2 Eligibility 

You must be at least 18 years old to book a surf coaching trip. Participants under the age of 18 must have written consent from a parent or legal guardian which you can find here: Parental Consent.


1.3 Booking and Payment 

Bookings are made through impactsurfacademy.com or through direct communication ie. email, phone call, and text with Impact Surf Academy and must be accompanied by a deposit or full payment. Full payment is required no later than 15 days before the Trip.


1.4 Trip Details 

Trip dates, locations, coaching programs, and accommodations are subject to change due to unforeseen circumstances. The Company will notify Participants of any significant changes. 


2. Health and Safety

3. Cancellation and Refund Policy


3.1 Cancellation by Participant 

If you wish to cancel your participation in the Trip, you must notify the Company in writing at coach@impactsurfacademy.com or by phone at +351-963-078-693. Cancellation fees will apply based on the timing of your cancellation as follows:

  • More than 30 before the Trip: Full refund minus a processing fee, of 50 euros.
  • 30-15 days before the Trip**: 50% of the total cost will be refunded.
  • Less than 15 days before the Trip**: No refund will be provided.


3.2 Cancellation by Company 

If the Company must cancel the Trip due to unforeseen circumstances such as weather conditions, insufficient bookings, or any other reason, you will be offered a full refund or a transfer to a future trip, based on your preference. The Company is not responsible for any other expenses (e.g., travel, accommodations) incurred by the Participant.


3.3 Changes by Participant 

If you wish to make changes to your booking (e.g., switching dates), requests will be handled on a case-by-case basis. A change fee may apply depending on the circumstances.
